35. Grant or refusal of request

(1) A licensee may grant or refuse a request.

(2) A licensee shall not grant a request where —
1. (a) it is known that the deceased left a written declaration to the contrary;
1. (b) the human remains have not been properly identified; or
1. (c) the provisions in this Act in relation to cremation have not been complied with.
