34.   Secondment of service and preservation of pension

  1.  

    (1)   Subject to subsections (2) and (3), an employee of the Board other than an employee under subsection (2) and (3), shall be employed by the Board on a contractual basis.

    (2)   Subject to the approval of the appropriate Service Commission or Statutory Authority, a public officer or an employee of a Statutory Authority, may, be seconded to the service of the Board, with the written consent of such person. (Amended by Act 31 of 2019)

    (3)   Where a secondment referred to in subsection (2) is effected, the rights, of the public officer so seconded, to any pension, gratuity or other allowance for which he or she would have been eligible had he or she remained in the public service, are preserved. (Amended by Act 31 of 2019)

    (4)   Where a public officer is seconded from a pensionable office within the meaning of section 2(1) of the Pensions Act, to perform any service with the Board, such service shall, unless the Governor General otherwise decides, count as pensionable. (Amended by Act 31 of 2019)

    (5)   Where a person who is a public officer, is seconded from a pensionable office within the meaning of section 2(1) of the Pensions Act to perform any service with the Government, such service shall, unless the Governor General otherwise decides, counts as pensionable.
