52.   Protection of members of the Board and officers of the medical complex

  1.  

    (1)   A civil action, suit or other proceeding shall not be brought or instituted personally against any member of the Board or officer of the medical complex in respect of any act or omission done in good faith in the due performance of his or her functions.

  1.  

    (2)   A civil action, suit or other proceeding shall not be brought or instituted against the medical complex unless —

    1.  

      (a)     the civil action, suit or other proceeding is filed within 12 months from the date of the act or omission complained of; and

    1.  

      (b)     notice of intended action has been given one month before the civil action, suit or other proceeding is brought or instituted.

  1.  

    (3)   The notice under subsection (2)(b) must —

    1.  

      (a)     be in writing;

    1.  

      (b)     specify the grounds of action;

    1.  

      (c)     be served on the medical complex.
