11.   Oath and confidentiality

  1.  

    (1)   The Commissioner, and every authorized officer shall take the oath specified in Schedule 1 before the Governor General.

    (2)   A person who is or has been the Commissioner, an officer of the Commissioner's staff or an agent of the Commissioner shall not make use of or divulge, either directly or indirectly, any data or information obtained as a result of the exercise of a power or in the performance of a duty under this Act, except —

    1.  

      (a)     in accordance with this Act or any other enactment; or

    1.  

      (b)     as authorized by an Order of the Court.

    (3)   A person who, without lawful excuse, contravenes subsection (2), commits an offence and is liable on summary conviction to a fine not exceeding $25,000. (Amended by Act 2 of 2015)
