(1) All deliberations or hearings in relation to an investigation under this Act may be conducted in private.
(2) In the course of a deliberation or hearing in relation to an investigation under this Act by the Commissioner, the person who made the complaint and the Permanent Secretary or the person responsible for the administration of the public authority or in any other case, the chief executive officer of the entity or establishment concerned, shall be given an opportunity to make representations to the Commissioner, but none is entitled as of right to be present during representations made to the Commissioner by any other person.
