50.   Selection of employees

  1.  

    (1)   A gaming operator shall not employ a person in his or her gaming establishment unless the gaming operator has conducted thorough checks on the person's character and antecedents, habits, associations and public reputation.

    (2)   A gaming operator shall establish a system to give effect to subsection (1) and shall provide the Authority with details of such system.

    (3)   A gaming operator who fails to establish a system as required by subsection (2) or who fails to inform the Authority of such system commits an offence.

  1.  

    (4)   A person employed in a gaming establishment shall—

    1.  

      (a)     be a citizen of Saint Lucia; and

    1.  

      (b)     not be permitted to play any game in any gaming establishment.

    (5)   Despite subsection (4) a gaming operator may obtain approval from the Authority to employ a person who is not a citizen of Saint Lucia if that person—

    1.  

      (a)     has specialist skills not available in Saint Lucia; or

    1.  

      (b)     performs senior management functions.

  1.  

    (6)   Where the Authority grants an approval under subsection (5) such approval shall be for a stated period and the Authority shall require that the gaming operator trains a suitable citizen of Saint Lucia to perform the function.

    (7)   A gaming operator who contravenes this section breaches his or her licence and is liable to revocation of the licence in accordance with section 23.
