(1) A person, who has not been issued a licence under this Act shall not—
(a) have, in his or her possession or in a place under his or her control, a gaming device or associated equipment; (Substituted by Act 18 of 2018)
(b) purchase or make a down payment for purchase of a gaming device or associated equipment. (Amended by Act 18 of 2018)
(2) A person who contravenes subsection (1) commits an offence and upon summary conviction is liable to a fine of $250,000 or to imprisonment for a term of 5 years.
(3) A gaming device or associated equipment which has not been approved by the Authority for use in Saint Lucia and which is not in the possession or control of the holder of a gaming distributor or gaming manufacturer licence shall be subject to confiscation by the Authority or a police officer not below the rank of inspector authorised by the Authority to act on its behalf.
