(1) All warrants, orders, convictions, and recognizances, criminal or civil, shall, subject to the provisions hereinafter contained, be issued under the hand of the magistrate.
(2) All summonses and other process may be issued under the hand of the magistrate or of the clerk or assistant clerk.
