3B.   Application for and grant of registration

  1.  

    (1)   A person wishing to import or export an ozone depleting substance shall, under subsection (2), apply to the National Ozone Unit for registration for that purpose.

    (2)   An application under subsection (1) must—

    1.  

      (a)     be in the prescribed form; and

    1.  

      (b)     be accompanied by the prescribed fee; and

    1.  

      (c)     state the purpose of the registration.

    (3)   The National Ozone Unit, if satisfied that a person making an application under this section complies with the prescribed conditions of registration, shall under subsection (4), register the applicant and issue a certificate of registration to the person.

    (4)   The National Ozone Unit may refuse to grant registration.

    (5)   Where the National Ozone Unit refuses to grant registration under this section, he or she shall so inform the applicant in writing stating the reasons for refusal.

    (6)   A certificate of registration must be in the prescribed form.

    (7)   The National Ozone Unit may revoke the registration of any person who fails to comply with the conditions for registration.

    (8)   A person who is aggrieved by the decision of the National Ozone Unit to refuse to grant registration or revoke registration may appeal to the Minister who shall give the person the opportunity to be heard.
