(1) The exemption under section 3 is subject to the conditions that Starlink Internet Services Limited —
(a) registers with the Commission within one year of the date of commencement of this Order before providing an aeronautical or a maritime mobile satellite service;
(b) has and maintains a contact number that is readily available;
(c) provides, on the request of the Commission or a duly authorized officer of the Commission, access for inspection and testing of apparatus used for the provision of that service;
(d) complies with a direction given by the Commission for avoiding interference with other telecommunications apparatus or a licensed telecommunications network;
(e) does not use the apparatus in a manner that causes harmful interference with other telecommunications apparatus or a licensed telecommunications network;
(f) does not violate an existing policy, code or international standard governing the use of aeronautical mobile satellite services;
(g) provides evidence that the installation and operation of the apparatus used for providing the aeronautical or maritime mobile satellite service is certified by the State in which the aircraft or ship is registered;
(h) shall not, unless specifically authorized by the Eastern Caribbean Civil Aviation Authority or another authority responsible for civil aviation, provide an aeronautical mobile satellite service when an aircraft is —
(i) below 7000 ft. altitude,
(ii) in its take-off;
(iii) taking off,
(iv) in its initial climb out,
(v) in its final approach position, or
(vi) landing or taxiing; and
(i) ensures that transmissions from the apparatus are automatically terminated on the loss or significant degradation of the downlink signal from the relevant geostationary satellite.
(2) For the purposes of subsection (1)(c), (d), (e), (f) and (g), Starlink Internet Services Limited shall register with the Commission, prior to the provision of an aeronautical or a maritime mobile satellite service in Saint Lucia and provide the following information and documents to complete the registration process —
(a) the name, email address, telephone number, fax number and location of the business place;
(b) the type of telecommunications services that Starlink Internet Services Limited intends to provide;
(c) the area where the telecommunications service will be provided;
(d) the type of customers that Starlink Internet Services Limited intends to serve;
(e) the type of equipment for use in providing the telecommunications service;
(f) a certified copy of the Certificate of Incorporation for Starlink Internet Services Limited; and
(g) a certified copy of the Certificate of Good Standing for Starlink Internet Services Limited.
