4.   Conditions

  1.  

    (1)   The exemption under section 3 is subject to the conditions that the service provider —

    1.  

      (a)     registers with the Commission before providing any telecommunications network or service in Saint Lucia;

    1.  

      (b)     has and maintains a contact number that is readily available;

    1.  

      (c)     provides, on the request of the Commission or an authorised officer of the Commission, access for inspection and testing of apparatus used for the provision of the telecommunications network and service;

    1.  

      (d)     complies with a direction given by the Commission for avoiding interference with other telecommunications apparatus or a licensed telecommunications network;

    1.  

      (e)     does not use the apparatus in a manner that would cause harmful interference with other telecommunications apparatus or a licensed telecommunications network;

    1.  

      (f)     does not violate an existing policy, code or international standard governing the use of wireless internet service; and

    1.  

      (g)     provides evidence that the installation and operation of the apparatus used for the provision of the wireless internet service has been certified by the Government of Saint Lucia.

  1.  

    (2)   For the purposes of subsection (1)(c), (d), (e), (f) and (g), the service provider must provide the following information and documents to complete the registration process —

    1.  

      (a)     the name, email address, telephone number, fax number and location of the business place;

    1.  

      (b)     the type of telecommunications service that the service provider wishes to offer;

    1.  

      (c)     the area where the telecommunications service will be provided;

    1.  

      (d)     the type of customers the service provider intends to serve;

    1.  

      (e)     the type of equipment to be utilised in providing the telecommunications service;

    1.  

      (f)     a certified copy of the Certificate of Incorporation for the service provider; and

    1.  

      (g)     a certified copy of the Certificate of Good Standing for the service provider.
