96.   Licence taken to be in force while application is considered

  1.  

    (1)   If an application for renewal is made under section 95, the applicant's licence is taken to continue in force from the day it would, apart from this section, have expired until—

    1.  

      (a)     if the Council decides to renew the licence, the day the renewal is issued to the applicant under section 97;

    1.  

      (b)     if the Council decides to refuse to renew the licence, the day the notice of the decision is given to the applicant under section 97; or

    1.  

      (c)     if the application is taken to have been withdrawn under section 92(4), the day it is taken to have been withdrawn.

    (2)   Subsection (1) shall not apply if the licence has been earlier suspended in accordance with the provisions of this Act.
