1.   Citation
  1.  

    These Regulations may be cited as the Distribution and Price of Goods Regulations.

2.   Interpretation
  1.  

    In these Regulations “Act” means the Distribution and Price of Goods Act.

3.   Form of requisition notice
  1.  

    For the purposes of section 3(3) of the Act, a notice to acquisition goods shall be in the form prescribed in Form 1 of the Schedule.

4.   Complaint form
  1.  

    For the purposes of section 25(1) of the Act, a person may make a complaint by a complaint form prescribed in Form 2 of the Schedule.

5.   Notice of hearing
  1.  

    For the purposes of section 26(2)(c) of the Act, a notice of hearing shall be in the form prescribed in Form 3 of the Schedule.

6.   Form of application for amendment of price order
  1.  

    For the purposes of section 30(2) of the Act, an application to amend a Price Order shall be in the form prescribed in Form 4 of the Schedule.

7.   Form of certificate designating authorized officer
  1.  

    For the purposes of section 44(3) of the Act, a certificate designating an authorized officer shall be in the form prescribed in Form 5 of the Schedule.

1.   Citation
  1.  

    This Order may be cited as the Price Control Order.

2.   Application
  1.  

    This Order applies to more than one type of goods and contains different provisions in relation to each type of goods.

3.   Interpretation
  1.  

    In this Order “landed cost” —

    1.  

      (a)     in relation to imported goods means the total value of —

      1.  

        (i)     the C.I.F. value of the goods at the port of entry,

      1.  

        (ii)     1% of the invoice value to cover the cost or remittance to place of payment,

      1.  

        (iii)     an amount equal to 5% of the C.I.F. value for local handling charge,

      1.  

        (iv)     an amount equal to 6% of the C.I.F. value for service charge,

      1.  

        (v)     the import duty payable on the goods;

    1.  

      (b)     in relation to cement, means the total value of —

      1.  

        (i)     the C.I.F. value of the cement at the port of entry,

      1.  

        (ii)     1% of the invoice value to cover the cost or remittance to place of payment,

      1.  

        (iii)     an amount equal to 15% of the C.I.F. value for local handling charges,

      1.  

        (iv)     an amount equal to 6% of the C.I.F. value for service charge,

      1.  

        (v)     the import duty payable on the goods;

    1.  

      (c)     does not include input Value Added Tax which is the total value of the applicable Value Added Tax rate of the sum of —

      1.  

        (i)     the C.I.F. value of the goods at the port of entry,

      1.  

        (ii)     the value of service charge,

      1.  

        (iii)     the value of the import duty paid on the goods.

4.   Declaration
  1.  

    The goods specified in the Schedule are declared goods.

5.   Fixation of maximum prices of goods
  1.  

    (1)   The wholesale and retail prices of the goods specified in the Schedule is as specified in the Schedule.

  1.  

    (2)   Notwithstanding subsection (1), a discretionary distributors mark-up of no more than 5% may be approved by the Director of Consumer Affairs upon a request made by a sole distributor.

TRADE (TREES CONTROL) REGULATIONS – SECTION 29

Commencement [14 December 1963]

1.   Citation

These Regulations may be cited as the Trade (Trees Control) Regulations.

2.   Definition

In these Regulations, unless the context otherwise requires—

Minister” means the member of Cabinet responsible for the subject of Trade and Industry;

occupier” includes a lessee, sub-lessee, or a person having any right or interest in trees growing on any land;

prescribed tree” means cacao, coconuts, breadfruit, citrus, bananas, sugar-cane or nutmegs.

3.   Prohibition of destruction or felling of trees

The Director of Agricultural Services may by notice—

  1.  

    (a)     served on the occupier of any land, or

  1.  

    (b)     published in the Gazette as respects the whole of the Island or any defined area therein,

prohibit or regulate the destruction or felling of any prescribed tree either subject to conditions or absolutely as he or she sees fit.

4.   Notice
  1.  

    (1)   Any notice required to be served under the preceding regulation shall be in writing.

  1.  

    (2)   Any such notice may be served either—

    1.  

      (a)     by delivering it to the person on whom it is to be served;

    1.  

      (b)     by leaving it at the usual or last known place of abode of that person; or

    1.  

      (c)     in a case where it is to be served on a body corporate, by delivering it to the secretary or clerk thereof at the registered or principal office thereof.

5.   Licences

The Director of Agricultural Services may grant to any person affected by a notice under the preceding regulation a licence to do anything which would otherwise be a contravention thereof, and any such licence may be granted subject to such conditions as the Director of Agricultural Services may determine.

6.   Appeal
  1.  

    (1)   Any person who is aggrieved by a notice under regulation 3 or by the refusal of the Director of Agricultural Services to grant a licence under the preceding regulation may within 15 days of the service of the notice as aforesaid or of the publication of the notice in the Gazette or of the refusal to grant a licence, as the case may be, appeal in writing to the Minister whose decision which shall be in his or her absolute discretion may include—

    1.  

      (a)     directions to the Director of Agricultural Services to cancel, vary, modify or suspend the notice; or

    1.  

      (b)     an order confirming the notice.

  1.  

    (2)   Any direction or order of the Minister shall be in writing.

7.   Penalty

Subject to the preceding regulation any person who without a licence as aforesaid does any act in contravention of a notice under regulation 3 or who fails to comply with any condition subject to which any licence has been granted commits an offence and is liable on summary conviction to a fine not exceeding $100 for each such act or non-compliance and in default to imprisonment for a term not exceeding one month.

8.   Inspection

Any person authorised in writing by the Director of Agricultural Services may enter on and inspect any land with a view to securing compliance with these Regulations or any notice or licence under them.
