42.   Appeal

  1.  

    (1)   There is hereby established an Appeals Tribunal for the purpose of hearing appeals against decisions of the Authority.

  1.  

    (2)   Subject to subsection (3), the Appeals Tribunal shall consist of the following members and shall be appointed by the Chief Justice—

    1.  

      (a)     an attorney-at-law of at least 5 years experience who shall be the Chairperson;

    1.  

      (b)     one person having expertise in practice and procedure of the Courts;

    1.  

      (c)     one person having expertise in business;

    1.  

      (d)     one person having expertise in consumer or social affairs.

  1.  

    (3)   A person shall not be appointed as a member of the Appeals Tribunal if the person—

    1.  

      (a)     has been convicted of a criminal offence except where the offence is a minor traffic offence or has been spent in accordance with the Criminal Records (Rehabilitation of Offenders) Act; or

    1.  

      (b)     is a member of Parliament.

  1.  

    (4)   An appeal from a decision of the Authority under this Act lies to the Appeals Tribunal.

  1.  

    (5)   A person may, within 14 days of notice of a decision of the Authority, apply in writing to the Appeals Tribunal against that decision.

  1.  

    (6)   An appeal from a decision of the Appeals Tribunal under this Act lies to the High Court.
