38.   Cancellation of certificate

  1.  

    (1)   Where an aided person fails to comply with any direction given by the Authority, the Authority may cancel the legal aid certificate.

    (2)   Prior to the cancellation of a legal aid certificate under subsection (1), the Authority shall give the aided person concerned notice in writing of its intention to do so, specifying the ground on which the Authority considers that the certificate ought to be cancelled and shall require the aided person to submit to it within a specified period being not less than 14 days a written statement of objections to the cancellation.

    (3)   A notice issued under subsection (2) must be served on the aided person personally or at his or her address.

    (4)   Having considered a statement of objection submitted under subsection (2), the Authority shall, by notice issued after the period specified in subsection (2) in accordance with subsection (3), inform the aided person of its decision and in the case of a decision to cancel shall include the reasons for the decision.

    (5)   A legal aid certificate that is cancelled is invalid.
