(1) A member of the Commission, who was nominated by and drawn from any of the bodies as set out in section 3(2)(b), may resign by informing the Chairperson in writing of his or her intention to resign and the date on which his or her resignation will take effect, and shall send a copy of such letter to his or her nominating body.
(2) A member of the Commission who was nominated by and drawn from any other bodies as set out in section 3(2)(a), may resign from the Commission if the member—
(a) is transferred to another Ministry;
(b) is promoted to a higher post; or
(c) resigns or retires from the Public Service.
