4.   Prohibited immigrants

  1.  

    (1)   Except as otherwise provided in this Act the immigration into Saint Lucia by sea or by air of any person being or appearing to be of any of the classes specified in this subsection is prohibited —

    1.  

      (a)     any person who is without visible means of support or is likely to become a pauper or public charge;

    1.  

      (b)     any person who is an idiot or epileptic or person of unsound mind, or mentally deficient, or deaf and dumb or deaf and blind or deaf or blind, if such person is likely to become a charge on public funds by reason of such infirmity;

    1.  

      I     any person suffering from any variety of leprosy or from a communicable disease, as certified by a Government Medical Officer;

    1.  

      (d)     any prostitute;

    1.  

      I     any person who lives on, or receives, or has lived on, or has received the proceeds of prostitution;

    1.  

      (f)     the children under the age of 16 years being dependents of a prohibited immigrant;

    1.  

      (g)     any member of a class of persons or any person specified in an Order made by Cabinet under subsection (3).

    (2)   The expression “communicable disease” in subsection (1)I means a communicable disease which makes the entry into Saint Lucia of a person suffering from it, dangerous to the community.

    (3)   Where Cabinet is satisfied —

    1.  

      (a)     that, on economic grounds or on account of standard or habits of life, the members of any class of persons are undesirable as immigrants;

    1.  

      (b)     on information or advice that any person is undesirable as an inhabitant of, or a visitor to, Saint Lucia; or

    1.  

      I     that, on the ground that a person has been convicted in any country of an offence for which a sentence of imprisonment has been passed and in respect of which he or she has not received a free pardon, such person is undesirable as an immigrant,

he or she may, by Order, declare the members of such class of persons or such persons as the case may be to be prohibited immigrants or a prohibited immigrant, and may direct that such persons or class of persons be removed from the Island forthwith or by such time as shall be stipulated.     (4)   Cabinet may from time to time exempt any person from the provisions of subsection (1)(a), (b), (c) or (f).

    (5)   No appeal shall lie against the decision of Cabinet in regard to any person mentioned in subsection (3)(a), (b) and (c).
