2.   Interpretation

(1)   In this Act—

approved” means approved by the Comptroller;

beer” includes ale, porter, spruce beer, and blackbeer and any other description of beer, and any liquor which is made or sold as a description of beer or as a substitute for beer, and which on analysis of a sample thereof at any time shall be found to contain more than 2% of proof spirit, or to have an original gravity exceeding 1012 degrees. However, the Minister has power to modify this definition or permit such exemptions as may be found desirable;

brewer” means a brewer of beer for sale, that is to say, any person who brews beer for the use of any other person at any place other than the premises of the person for whose use the beer shall be brewed, and any person licensed to deal in or retail beer, who brews beer;

Comptroller” means the Comptroller of Customs and Excise;

Minister” means the Minister to whom the responsibility for customs and excise has been assigned;

officer” means the Comptroller or any Supervisor or any officer of the Customs and Excise Department designated by the Comptroller;

original gravity” means the gravity of beers, maltas or malta liquors before fermentation has commenced;

other malt beverage” means any non-alcoholic brewed malt beverage or such beverage containing less than 2% of proof spirit or any liquor sold under the description of malta, malt beverage or malt liquor;

prepared grist” means rice, and any other description of corn which may have been subjected to any special process, other than malting, for use in brewing;

required” means required by the comptroller;

sugar” means any saccharine substance, extract, or syrup, and includes any material capable of being used in brewing except malt or corn;

State” means the State of Saint Lucia;

wort” means any extract or solution convertible into beer.

    (2)   The provisions of this Act, except section 3(5) shall apply with the necessary modifications to other malt beverage as they apply to beer.
