(1) Where a vacancy occurs in the membership of the Commission, the Governor General may where necessary, after consultation with the person who nominated that member appoint a person, qualified under section 4(1), to act for the remainder of the term specified in the instrument of appointment of the member whose membership became vacant.
(2) A vacancy in the membership of the Commission occurs—
(a) on the death, resignation or revocation of the appointment, of a member;
(b) on the expiration of the term specified in a member's instrument of appointment; or
(c) on the failure of a member to attend 3 consecutive meetings of the Commission without reasonable cause.
