VALIDITY

15.   Validity of international trust

  1.  

    (1)   An international trust is valid and enforceable if it meets the requirements of this Act and although it may be invalid according to the law of the settlor's domicile, residence or place of incorporation.

    (2)   An international trust is invalid and unenforceable to the extent that—

    1.  

      (a)     in the administration of the trust anything done that is contrary to the law in force in Saint Lucia; or

    1.  

      (b)     it purports to confer a right or power, or to impose any obligation, the exercise or effect of which is contrary to the law in force in Saint Lucia.
