(1) A person who derives a profit or obtains trust property as a result of a breach of an international trust shall be deemed to be a trustee of such profit or trust property unless that person derives or obtains it in good faith and without actual, constructive or implied notice of the breach of trust.
(2) A person who becomes a trustee by virtue of subsection (1) shall deliver up the profit or trust property to the person properly entitled to it.
(3) This section does not exclude any other circumstance in which a constructive trust may arise.
