OFFENCES BY WITNESSES

20.   Witnesses failing to attend, or refusing to answer questions or produce documents

A person commits an offence who—

  1.  

    (a)     fails without reasonable excuse, the proof whereof shall be upon him or her, to attend before the House or a committee when so required by an order made under the provisions of section 9; or

  1.  

    (b)     refuses to be examined before, or to answer any questions put by, the House or a committee, or to produce any paper, book, record or other document which he or she has been required to produce by an order made under the provisions of section 9, unless such question or paper, book, record or other document is not, in the opinion of the Speaker or the chairperson of the committee, as the case may be, material to the subject of the inquiry of the House or committee or such refusal is allowed under the provisions of section 14 of this Act,

    and is liable on conviction by a court of summary jurisdiction to a fine not exceeding $120 or to imprisonment for a term not exceeding 3 months or to both such fine and imprisonment.
