3.   Eligibility for gratuity

1.  

   (1)   Subject to the provisions of this Act, a legislator—

   1.  

      (a)     who has served as a Minister for a period or periods which amount in the aggregate to not less than 4 years;

   1.  

      (b)     who has served as Speaker of the House of Assembly, President of the Senate, Parliamentary Secretary or Leader of the Opposition for a period or periods in the aggregate of not less than 4 years, and

1.  

   who has ceased to be a Minister or to hold an office described in paragraph (b) before or after the commencement of this Act shall be paid a gratuity at a rate of 25% of the aggregate of the salary payable to that legislator throughout the period served or the period specified in section 4(2).

   (2)   The gratuity payable under this section shall be paid without prejudice to any other award to which a person is entitled under this Act.
