2. Interpretation

(1) In this Act, unless the context otherwise requires —
“citizen of a Protocol Member State” —
-
(a) means a person, other than a citizen of Saint Lucia, who is a citizen of a member state of the Organisation of Eastern Caribbean States that is a party to the Protocol of the Eastern Caribbean Economic Union;

(b) does not apply to a person who becomes a citizen of a Protocol Member State under an economic or honorary citizenship programme of that Protocol Member State, unless that programme is comparable to an economic or honorary citizenship programme in force in Saint Lucia and approved as such by the Minister responsible for external affairs;

“dependent”, in relation to another person means —

(a) the wife of such person unless she is living apart from him under a deed of separation or the decree of a competent court;

(b) the child or step-child under the age of 16 years, of such person;

I an adopted child under the age of 16 years having been adopted by such person in a manner recognised by law;

(d) any other relative of such person who is wholly dependent on such person for his or her subsistence;
“domicile” means the place in which a person has his or her present home or in which he or she resides or to which he or she returns as his or her place of present permanent abode and not for a mere special or temporary purpose, and domiciled shall have a corresponding meaning; (Amended by Act 15 of 1983)
“immigrant” means a person who enters Saint Lucia from a place outside Saint Lucia, whether for the first time or at any subsequent time;
“immigration officer” means the Chief Immigration Officer, any immigration officer appointed by the Minister and any member of the Police Force _uthorized under section 3(3) to exercise and perform the powers, functions, or duties of an immigration officer; (Amended by Act 3 of 1991)
“master” means the person having command or charge of a vessel;
“Minister” means the Minister to whom the subject of Home Affairs has been assigned; (Inserted by Act 3 of 1991)
“passport” means a valid passport referring to the person producing the same, furnished with a photograph of such person and duly issued to him or her by or on behalf of the Government of the country of which he or she is subject or citizen, and for a period which, according to the laws of that country, has not expired, and includes a certificate of identity or a travel permit and any other document establishing to the satisfaction of an immigration officer the nationality and identity of the person to whom it refers;
“Protocol of the Eastern Caribbean Economic Union” means the Protocol of the Eastern Caribbean Economic Union to the Treaty of Basseterre establishing the Organisation of Eastern Caribbean States Economic Union; (Inserted by Act 21 of 2014)
“Treaty of Basseterre establishing the Organisation of Eastern Caribbean States Economic Union” means the Treaty of Basseterre establishing the Organisation of Eastern Caribbean States Economic Union done at Castries on the 18th June 2010. (Inserted by Act 21 of 2014)

(2) For the purposes of this Act a person enters Saint Lucia if he or she arrives by sea or by air, with the intention of disembarking or if he or she disembarks in Saint Lucia.
