46.   Establishment of polling stations

  1.  

    (1)   The returning officer shall establish for each polling division such number of polling stations as the Chief Elections Officer shall determine, each polling station being in premises of convenient access, with an outside door for the admission of electors, and, where possible, with another door through which electors may leave after they have voted, and each presiding officer shall take care beforehand that his or her polling station is provided with proper doors, barriers, tables, chairs and other conveniences, and that the same are properly arranged for carrying out this Act with respect to the taking of the poll.     (2)   Where a hospital, care facility or other similar institution exists in a polling division, the returning officer shall establish an advance polling station to take an advance poll in such institutions. (Inserted by Act 13 of 2016)

    (3)   Before establishing an advance polling station, the returning officer shall be satisfied that the institution has level access as far as practicable to facilitate persons with physical disabilities or convenient access. (Inserted by Act 13 of 2016)

    (4)   Notwithstanding subsection (2), the returning officer shall establish advance polling stations to take an advance poll for registered electors of—

    1.  

      (a)     the Commission;

    1.  

      (b)     the Electoral Department including—

      1.  

        (i)     the Chief Elections Officer and Staff,

      1.  

        (ii)     polling day workers such as the returning officer, election clerk, assistant election clerk, presiding officer, poll clerk and assistant poll clerk;

    1.  

      (c)     the Royal Saint Lucia Police Force;

    1.  

      (d)     the Fire Service; or

    1.  

      (e)     any correctional facility in the polling division consisting of the officers and staff of the correctional facility.
