4.   Registration of holding

  1.  

    (1)   Every person in possession or control of any parcel of land on which bananas are grown for export shall register with the Authority in such manner as may be prescribed such parcel of land as a holding.

    (2)   For the purpose of registration under subsection (1), such parcel of land shall not be subdivided except by way of bona fide sale, lease or gift.

    (3)   Subject to the provisions of subsection (4), where 2 or more parcels of land on which bananas are grown for export adjoin or are contiguous and such parcels of land are in the possession or control of the same person, then if application in the prescribed manner has been made by such person for the registration of such parcels of land as separate holdings, such parcels of land shall be deemed to be and be registered as one holding.

    However, this subsection shall not apply where such parcels of land belong to different owners and are in the possession or control of a person who holds the same as agent for the different owners.

    (4)   Where 2 or more parcels of land each being not less than 100 acres and on each of which bananas are grown for export adjoin or are contiguous and such parcels are in the possession or control of the same person, the Authority may, if satisfied that—

    1.  

      (a)     there are planted on each such parcel of land at least 25,000 mats;

    1.  

      (b)     each such parcel(s) of land has clear and distinct boundaries; and

    1.  

      (c)     each such parcel of land is worked as a separate entity with separate records of account,

  1.  

    permit each such parcels of land to be registered as a separate holding.
