13.   Unproductive and uneconomic holding

  1.  

    (1)   Where—

    1.  

      (a)     any holding or part thereof has not been replanted for at least 4 consecutive years, and

    1.  

      (b)     in the opinion of the Authority any such holding or part thereof is unproductive and uneconomic, the Authority may, by notice in writing served on the grower, declare any such holding or part thereof to be unproductive and uneconomic.

    (2)   The notice shall contain the reasons for the declaration and shall require the grower to replant or to take such other remedial action with regard to any such holding or part thereof as the Authority may therein specify.

    (3)   Any grower, who is aggrieved by any such declaration of the Authority, may, within 14 days of the service of the notice upon him or her, appeal in the prescribed manner and in the prescribed form to the tribunal established under section 14 and the decision of the tribunal on the matter shall be final.

    (4)   Where—

    1.  

      (a)     a grower has not exercised his or her right of appeal within the time specified; or

    1.  

      (b)     an appeal by him or her under subsection (3) has been unsuccessful,

  1.  

    then, in either case, the relevant holding shall until compliance with the declaration be ineligible for insurance benefit.
