7.   Offence of transporting a person for the purpose of exploiting such a person's prostitution

  1.  

    (1)   A person who—

    1.  

      (a)     knowingly transports;

    1.  

      (b)     conspires to transport;

    1.  

      (c)     attempts to transport; or

    1.  

      (d)     assists another person engaged in transporting,

    1.  

      a person to Saint Lucia, or across an international border for the purposes of exploiting that person for prostitution commits an offence and is, subject to subsection (2), liable on conviction on indictment to imprisonment for a term not exceeding 5 years.

    (2)   The presence of any one of the following aggravating factors resulting from acts of the defendant may permit a longer sentence up to 10 years, together with forfeiture of the conveyance used for transporting the victim—

    1.  

      (a)     transporting two or more persons at the same time;

    1.  

      (b)     causing permanent or life-threatening bodily injury to the person transported;

    1.  

      (c)     transporting of one or more children;

    1.  

      (d)     transporting as part of the activity of an organized criminal group.
