5.   Offence of trafficking in persons

  1.  

    (1)   A person who—

    1.  

      (a)     engages in;

    1.  

      (b)     conspires to engage in;

    1.  

      (c)     attempts to engage in;

    1.  

      (d)     assists another person to engage in; or

    1.  

      (e)     organizes or directs another person to engage in,

    1.  

      trafficking in persons commits an offence and is liable on conviction on indictment to a term of imprisonment not exceeding five years.

      (Substituted by Act 3 of 2021)

  1.  

    (2)   The recruitment, transportation, harbouring, or receipt of a child, or giving of payment or benefits to obtain the consent of a person having control of a child, for the purpose of exploitation, constitutes trafficking in persons irrespective of whether any of the means of trafficking in persons has been established.
