4.   Payment of gratuity on death of legislator

1.  

   (1)   Where a legislator who would have been entitled to a gratuity under section 3 or who had opted for a gratuity under section 9 dies before the gratuity has been paid, payment shall be made—

   1.  

      (a)     to the legal representative of that legislator; or

   1.  

      (b)     where the legislator has no legal personal representative, to the dependants of the legislator as the appropriate Minister thinks fit.

   (2)   Despite section 3, where a legislator dies while serving as a member of the House of Assembly or of the Senate and at the date of the legislator's death the legislator did not qualify for the payment of a gratuity under section 3, an amount equal to the gratuity that would have been payable in respect of the period specified under that section shall be paid—

   1.  

      (a)     to the legal personal representative of the legislator; or

   1.  

      (b)     where the legislator has no legal personal representative, to the dependants of the legislator as the appropriate Minister thinks fit.
