4.   Restrictions on the use of power-craft, water skis

  1.  

    (1)   Any person who operates a power-craft, water-ski, surf-board, water-sleigh or other towed object of a similar nature within the territorial sea of this Island in a manner which is dangerous to navigation or to the life or limb of any other person, having regard to all the circumstances including the nature and condition of that sea and the use that at the time is or might reasonably be expected to be made of that sea, is liable on summary conviction to a fine not exceeding $500 and, in default of payment, to imprisonment for a term not exceeding 6 months.

    (2)   Any person who operates a power-craft, water-ski, surf-board, water-sleigh or other towed object of a similar nature within the territorial sea of this Island so as to create a nuisance to any other person or boat (whether anchored or not) is liable on summary conviction to a fine not exceeding $100 and, in default of payment, to imprisonment for a term not exceeding one month.

    (3)   Any person who operates a power-craft within the territorial sea of this Island while towing another person on a water-ski, surf-board, water-sleigh or other object of a similar nature when there is not on board the power-craft another person of or above the age of 16 keeping watch on the person being towed is liable on summary conviction to a fine not exceeding $200, and in default of payment to imprisonment for a term not exceeding 2 months.

    (4)   Any person who, while his or her ability to operate a power-craft is impaired by alcohol or a drug, operates a power-craft within the territorial sea of this Island, commits an offence.
