19.   Failure of debtor to attend hearing of application

Where after being served with a summons or a notice of an application to a Court for an attachment of earnings order or for the variation of such an order, the debtor fails to attend on the day and at the time specified for any hearing of the application, the Court may adjourn the hearing and order him to attend at a specified time on another day and if the debtor fails to attend at that time on that day, or attends, but refuses to be sworn or give evidence, the Court may proceed to hear the application despite his absence or refusal to be sworn or to give evidence.
