(1) There is hereby established for the purposes of this Act a board to be known as the Hospitals Board, which shall consist of a chairperson, the Chief Medical Officer and other members not being less than 5 nor more than 10 that the Minister appoints.
(2) A member of the Board shall hold office for the period specified on his or her instrument of appointment not exceeding 2 years, but shall be eligible for re-appointment.
(3) Where for any reason the chairperson is unable to carry out his or her functions under this Act, the members of the Board may elect one of their number to be chairperson who may exercise all the functions of the chairperson until the chairperson is again able to carry out such functions or until another person is appointed chairperson.
(4) Where a member other than the chairperson is granted leave in accordance with subsection (6) or is otherwise unable to perform the functions of his or her office, the Minister may appoint some other person to act as a temporary member during such absence or inability.
(5) A member of the Board may at any time resign his or her office by instrument in writing addressed to the chairperson who shall cause it to be forwarded to the Minister and the chairperson may resign his or her office by instrument in writing addressed to the Minister. Resignation shall take effect on the date of receipt of the instrument by the chairperson or the Minister as the case may be.
(6) The Minister may, on application of a member grant such member leave of absence for a period not exceeding 3 months.
(7) Despite subsection (4) the Minister may if he or she thinks it expedient so to do, at any time revoke the appointment of any member.
(8) The names of all the members of the Board as first constituted and every charge thereof shall be published in the Gazette.
