4.   Adaptation of trusts

  1.  

    (1)   All lands and personal chattels in Saint Lucia held upon trust, for the purposes of the Parent Church, by the Missionary Society or any of their local or ancillary bodies in connection with the work in the Conference area, shall on or after the commencement of this Act be held by the agents upon similar trusts for the purposes of the Church or of its corresponding local or ancillary body and as if references to the Church were substituted for references to the Parent Church or the Missionary Society in any declaration of such first-mentioned trusts but otherwise with and subject to the powers and provisions applicable thereto immediately before the commencement of this Act.

    (2)   All moneys, bank accounts and choses in action held in Saint Lucia by or on behalf of or in trust for any local body of the Parent Church or the Missionary Society now forming part of the Church shall continue to be held by the agents by or on behalf of the said local body but in its capacity as a local body of the Church rather than of the Parent Church or the Missionary Society.

    (3)   Whenever the words “Methodist Church” or “Conference” are used in any Act, Deed, Will or other instrument as applying to the Parent Church or in British Conference in connection with work now carried on by the Church such words shall on and after the passing of this Act be construed in their application to property to mean the Church and the Conference respectively.

    (4)   Any device or bequest contained in a Will or Codicil made by any person living at the commencement of this Act in favour of or directed to be administered by or in connection with the Parent Church, the Missionary Society or any of their local or ancillary bodies in connection with work now carried on by the Church shall (save in so far as such device or bequest is on its true construction intended to be applied for work of the Parent Church or of the Missionary Society carried on outside the area of the Church) take effect in favour of or be administered by the agents or in local or ancillary body and as if references to the Church were substituted for references to the Parent Church or the Missionary Society in such Will or Codicil, but otherwise subject to the powers and provisions set out therein.
