(1) A user or his or her representative may complain to the Commission in respect of any of the matters under section 9.
(2) The Commission may recognise as a user's representative a person not chosen by the user and may receive a complaint from that person on the user's behalf if in the Commission's opinion—
(a) the user is unable to complain; or
(b) the user is unable to choose a representative; and
(c) the person who wishes to represent the user has a sufficient interest in the subject matter of the complaint.
(3) A health service worker may complain to the Commission in respect of any matter under section 9.
(4) A person who complains to the Commission may at any time withdraw the complaint by notifying the Commission and the Commission shall determine whether or not to terminate its investigation.
