(1) There is hereby established a Health Services (Complaints and Conciliation) Commission to be appointed by the Cabinet and comprising the following members—
(a) a retired judge of the High Court or an attorney-at-law of at least 10 years standing at the Bar;
(b) a medical practitioner of at least 10 years standing or retired medical practitioner nominated by the Saint Lucia Medical and Dental Association;
(c) a nurse of at least 10 years standing or a retired nurse nominated by the Saint Lucia Nurses Association; and
(d) two persons experienced in matters of public administration who shall—
(i) be nominated by the Governor-General,
(ii) represent the public interest, and
(iii) not be serving officers in the public service.
(2) The Cabinet shall appoint one of the members mentioned in subsection (1) to be the Chairperson.
(3) A member of the Commission shall hold office for a term, not exceeding 3 years, specified in his or her letter of appointment, and shall be eligible for re-appointment.
(4) A member of the Commission may resign his or her position in writing addressed to the Chairperson and the Chairperson may resign in writing addressed to the Secretary to Cabinet.
(5) During the temporary absence or incapacity of a member of the Commission the Cabinet may appoint a person selected in accordance with subsection (1) to act in place of the absent or incapacitated member.
(6) A member of the Commission may be removed from his or her office by the Cabinet if—
(a) there is a conflict of interest on the part of the member; or
(b) where there is a withdrawal of support by the body that nominated that member; or
(c) where it is in the public interest to do so.
