7.   Limitations on power to make development order where applicant recognised under other incentive legislation

  1.  

    (1)   Although prior to the date of the commencement of this Act a product has been declared to be a pioneer product under the Aid to Pioneer Industries Act, 1951 this Act shall not prevent the pioneer manufacturer of such product from applying for a development order under this Act with respect to such product if—

    1.  

      (a)     the application is made to the Minister within 3 months from the date of the commencement of this Act; and

    1.  

      (b)     the applicant (where necessary) becomes a company,

    and the Governor General may make such order upon such terms and conditions to be specified therein as regards adjustment of benefits received under the Aid to Pioneer Industries Act, 1951 or otherwise as he or she may think fit.

    (2)   Subject to the provisions of the preceding subsection, the Governor General shall not make a development order in respect of an enterprise which is approved, recognised or licensed for the purpose of any Act specified in Schedule 1.

    (3)   Upon a development order being made under subsection (1) the applicant shall cease to be a pioneer manufacturer and the industry shall cease to be a pioneer industry under the Aid to Pioneer Industries Act, 1951.
