(1) Regulation 3 does not apply to a person who has a reasonable excuse for not wearing a mask.
(2) Without limiting subregulation (1), a person has a reasonable excuse for not wearing a mask if the person is —
(a) driving or is a passenger in a motor vehicle;
(b) a child who is under 5 years;
(c) a student who sits at a distance of three feet in a classroom;
(d) a person who is having a meal at a restaurant;
(e) a person who is exercising at the gym;
(f) a person who cannot wear a mask because of a physical or mental illness, impairment or disability;
(g) a person who is directed by a health practitioner to remove the mask for carrying out a medical or surgical treatment;
(h) a person who is receiving a service including a service from a barber shop, beauty salon or other similar service; or
(i) a person who is seabathing or in a swimming pool.
(3) In this section, “motor vehicle” does not include a tourism taxi or taxi.
