4.   Condition of licence

(1)   Without prejudice to regulation 22 of the Fisheries Regulations a licence is subject to the conditions that —

(a)     the following is kept in safe custody —
-  
(i)     in the case of the master —
-  
(A)     the registration card; and
 
-  
(B)     the licence;
 
 
-  
(ii)     in the case of each crew member, the registration card,
 
 
 
to be produced for inspection at a reasonable time when required by an authorized officer;

(b)     before leaving a port, the master of the local fishing vessel contacts the Vigie Light House or the Moule a Chique Light House by telephone or by a Maritime Mobile Radio to provide the following information —

(i)     the local fishing vessel number,

(ii)     the master's name,
 
-  
(iii)     the master's registration card number,
 
-  
(iv)     the number of crew members on board the local fishing vessel,
 
-  
(v)     the name of each crew member;

(c)     the names of crew members on board the local fishing vessel is consistent with the names registered as local fishermen in the register; and
 
-  
(d)     the number of crew members on board the local fishing vessel is consistent with the number of crew members specified on application for a licence.

(2)   In this regulation —
 
“authorized officer” means —
-  
(a)     a fisheries officer;
 
-  
(b)     a customs officer;
 
-  
(c)     a police officer;
 
-  
(d)     a person or category of persons designated under section 26 of the Fisheries Act;
 
“Maritime Mobile Radio” means radio equipment —
-  
(a)     for which a person is granted a certificate of type approval under the Telecommunications Act; and 
 
-  
(b)     that uses Channel 16 in the very high frequency band; 
 
“registration card” means a registration card granted under regulation 24(2) of the Fisheries Regulations.
