TRIAL PROCEDURE
1. Trial
-
A district court shall hold a trial in a proceeding commenced by means of a ticket, if —
-
(a) the defendant requests a trial in accordance with section 63I; or
-
(b) more than fourteen days have elapsed since the date of service of the ticket and the person alleged to have committed the offence has not exercised any of the options referred to in section 63G.
2. Attendance of the police officer
-
If a defendant in responding to a ticket indicates that the attendance of the police officer who completed the ticket is required for the purposes of cross-examination, the Commissioner of Police shall ensure that the police officer attends the trial.
3. Court shall not require defendant to appear personally
-
Notwithstanding any provision in any enactment regarding appearance in Court by a defendant, if the defendant appears for the trial by counsel or agent, the Court shall not issue a warrant for the arrest of the defendant.
4. Ex parte trial where defendant and agent absent
-
If the defendant does not appear for the trial in person or by counsel or agent and the Court is satisfied that the defendant was served with the ticket and notified of the time and place of the trial, the Court may —
-
(a) after directing the clerk to enter a plea of not guilty, proceed with the trial in the absence of the defendant; or
-
(b) adjourn the proceeding and fix a new trial date, if the prosecution requests.
5. Non-appearance of defendant at new trial
-
If the defendant does not appear for the trial at the new trial date fixed under paragraph (4)(b), the Court shall, after directing the clerk to enter a plea of not guilty, proceed with the trial in the absence of the defendant.
6. Non-appearance of defendant at resumption of trial
-
If the trial begins, either on the date originally fixed or on the new date fixed under paragraph (1)(b) or 4(b), but is adjourned and the defendant does not appear for the resumption of the trial, the Court may —
-
(a) either adjourn the trial and fix a new date for its resumption on any term that the Court considers proper or resume the trial in the absence of the defendant; or
-
(b) shall resume the trial in the absence of the defendant, if the proceeding has previously been adjourned as a result of the defendant not appearing.
7. Warrant of arrest
-
Notwithstanding any provision in any enactment regarding appearance in Court by a defendant, if the defendant does not appear for the trial or a resumption of the trial, a warrant for the arrest of the defendant shall be issued.
8. Dismissal where crown absent
-
If the defendant appears for the trial but the prosecution does not and the Court is satisfied that the prosecution was notified of the time and place of the trial, the Court or justice may —
-
(a) adjourn the proceeding and fix a new trial date, on any terms that the Court considers proper; or
-
(b) where there have been previous adjournments and no satisfactory reason is provided for the continued absence of the prosecution, dismiss the proceedings.
9. Dismissal of proceeding
-
If the defendant appears for the trial at the new trial date fixed under paragraph 8(b) but the prosecution does not, the Court shall dismiss the proceeding.
10. Non-appearance under paragraph 4(b) or 8(b)
-
If the trial begins, either on the date originally fixed or on the new date fixed under paragraph 8(b) or 4(b), but is adjourned and the prosecution does not appear for the resumption of the trial, the Court may —
-
(a) either adjourn the trial and fix a new date for its resumption,
on any terms that the Court considers proper; or
-
(b) shall dismiss the proceeding, if it has previously been adjourned as a result of the prosecution not appearing.
11. Notice of new trial date
-
As soon as practicable after the Court fixes a new trial date or a new date for the resumption of the trial, the clerk of the Court shall notify the defendant and the prosecution of its time and place.
12. Notice of conviction
-
As soon as practicable after a person is convicted in his or her absence, the clerk of the Court shall cause a notice of the conviction, the amounts of any fine, fees and costs and any time allowed for their payment to be sent to the person by ordinary mail.

1. Citation
These Regulations may be cited as the COVID-19 (Prevention and Control) (Fees) Regulations.
2. Application
These Regulations apply to a visitor, returning national or other category of persons arriving in Saint Lucia who are placed in quarantine.
3. Fees at quarantine facility
-
(1) The fees for quarantine at a quarantine facility are as specified in Part A of the Schedule.
-
(2) Notwithstanding subregulation (1), a child pays 50% of the fee payable by an adult in any fee specified in Part A of the Schedule.
-
(3) Fees for quarantine under subregulation (1) must be paid directly to the quarantine facility.
4. Fees for electronic monitoring device
-
(1) The fees for an electronic monitoring device are as specified in Part B of the Schedule.
-
(2) Fees for an electronic monitoring device under subregulation (1) must be paid to the Ministry responsible for health or any supplier that the Ministry designates.
5. Fee for COVID-19 test
The fee for a COVID-19 test is as specified in Part C of the Schedule.

1. Citation
These Regulations may be cited as the COVID-19 (Prevention and Control) (Protocol) (Fishing) Regulations.
2. Interpretation
In these Regulations —
“licence” means a licence issued in respect of a local fishing vessel under regulation 19 of the Fisheries Regulations;
“local fisherman” means the master and every member of a crew of a local fishing vessel registered as a local fisherman in the register;
“register” means the register of local fishermen under regulation 24 of the Fisheries Regulations.
2. Application
These Regulations apply to a local fisherman.
3. Fishing
-
(1) A local fisherman may undertake fishing or related activities from the 5th day of November, 2020.
-
(2) Notwithstanding subregulation (1), a local fisherman shall not undertake fishing or related activities from 6 p.m. to 4 a.m. each day.
-
(3) In this regulation —
“fishing” has the meaning assigned under the Fisheries Act;
“related activities” has the meaning assigned under the Fisheries Act.
4. Condition of licence
-
(1) Without prejudice to regulation 22 of the Fisheries Regulations a licence is subject to the conditions that —
-
(a) the following is kept in safe custody —
-
(i) in the case of the master —
-
(A) the registration card; and
-
(B) the licence;
-
(ii) in the case of each crew member, the registration card,
to be produced for inspection at a reasonable time when required by an authorized officer;
-
(b) before leaving a port, the master of the local fishing vessel contacts the Vigie Light House or the Moule a Chique Light House by telephone or by a Maritime Mobile Radio to provide the following information —
-
(i) the local fishing vessel number,
-
(ii) the master's name,
-
(iii) the master's registration card number,
-
(iv) the number of crew members on board the local fishing vessel,
-
(v) the name of each crew member;
-
(c) the names of crew members on board the local fishing vessel is consistent with the names registered as local fishermen in the register; and
-
(d) the number of crew members on board the local fishing vessel is consistent with the number of crew members specified on application for a licence.
-
(2) In this regulation —
“authorized officer” means —
-
(a) a fisheries officer;
-
(b) a customs officer;
-
(c) a police officer;
-
(d) a person or category of persons designated under section 26 of the Fisheries Act;
“Maritime Mobile Radio” means radio equipment —
-
(a) for which a person is granted a certificate of type approval under the Telecommunications Act; and
-
(b) that uses Channel 16 in the very high frequency band;
“registration card” means a registration card granted under regulation 24(2) of the Fisheries Regulations.
5. Suspension of licence
-
(1) A licence may be suspended for a period of one year if the local fishing vessel is used for human trafficking activities or to allow entry of a prohibited immigrant into Saint Lucia.
-
(2) In this regulation, “prohibited immigrant” means a person deemed to be a prohibited immigrant under section 8(4) of the Immigration Act.
6. Penalty
A local fisherman who contravenes these Regulations commits an offence and is liable on summary conviction to a fine not exceeding $1,000 or imprisonment with or without hard labour for a term not exceeding 6 months or both and forfeiture of goods or money in respect of which the offence has been committed.
7. Revocation
The COVID-19 (Prevention and Control) (Restriction of Access to Area) Order, Statutory Instrument, No. 165A of 2020 is revoked.

COVID-19 (PREVENTION AND CONTROL) (SUSPENSION OF LIQUOR LICENCE) ORDER – SECTION 15
Commencement [3 February 2021]
1. Citation
This Order may be cited as the COVID-19 (Prevention and Control) (Suspension of Liquor Licence) Order.
2. Interpretation
In this Order —
“Act” means the COVID-19 (Prevention and Control) Act;
“Commissioner” means the Commissioner of Police under the Police Act;
“licence” means a licence issued under the Liquor Licence Act, authorizing the sale or barter of intoxicating liquor;
“licensee” means a person who has been granted a licence under the Liquor Licence Act;
“licensed premises” includes a building, yard or place for which a licence has been granted under the Liquor Licence Act;
“police officer” means a member of the Police Force established under section 3 of the Police Act.
3. Direction of police officer
-
(1) Without prejudice to the Police Act, where the Commissioner or a police officer designated by the Commissioner, believes on reasonable grounds that a licensee is in breach of a protocol under the Act, the Commissioner or a police officer designated by the Commissioner, may —
-
(a) direct the licensee to rectify the breach immediately; and
-
(b) if the licensee fails to rectify the breach, recommend to the Minister, that the licence be suspended.
-
(2) A recommendation to the Minister under subsection (1) must be in writing, and state —
-
(a) the name of the licensee;
-
(b) the name of the licensed premises;
-
(c) the protocol breached under the Act; and
-
(d) whether the protocol breach is continuing.
4. Grounds for suspension of liquor licence
Subject to section 5, the Minister may, on the recommendation of the Commissioner of Police or a police officer designated by the Commissioner, suspend a licence under the Act, where a person who is the owner, operator or manager of licensed premises and while on the licensed premises —
-
(a) breaches a protocol under the Act;
-
(b) permits a breach, by a person on the licensed premises, of a protocol under the Act; or
-
(c) is charged with a criminal offence under the Act.
5. Rectification and notice of suspension of liquor licence
-
(1) On receipt of the recommendation under section 3 and if the grounds under section 4 exists, the Minister shall direct the licensee to immediately rectify the breach.
-
(2) If a licensee fails to rectify the breach under subection (1), the Minister shall issue and serve notice, in writing, to the licensee to inform of the suspension of the licence.
-
(3) A notice under subsection (2) must contain —
-
(a) the name of the licensee;
-
(b) the name of the licensed premises;
-
(c) the protocol breached under the Act;
-
(d) the grounds on which the licence is suspended;
-
(e) the duration of time for which the licence is suspended, in accordance with section 7;
-
(f) the date of commencement and the date of termination of the suspension.
-
(4) A person who is served a notice of suspension of a licence under subsection (1) may, within one day of receipt of the notice, write to the Minister requesting an opportunity to be heard and providing details as to grounds on which the licence should not be suspended.
6. Order for the suspension of liquor licence
-
(1) An Order for the suspension of a licence may be issued if the details as to grounds on which the licence should not be suspended are not reasonable and the suspension is reasonably justified in the public interest.
-
(2) For the purpose of section 15 of the Act, an Order for the suspension of a licence, must contain —
-
(a) the name of the licensee;
-
(b) the name of the licensed premises;
-
(c) the grounds on which the licence is suspended;
-
(d) the duration of time for which the licence is suspended, in accordance with section 7;
-
(e) the date of commencement and the date of termination of the suspension.
7. Period of suspension of liquor licence
A licence suspended under the Act may —
-
(a) in the instance of the first breach under the Act, be suspended for a maximum period of seven days;
-
(b) after the instance of the first breach under the Act, be suspended for a maximum period of fourteen days.

For the purposes of section 63A of the Act, a warning notice is in Form 1 set out in the Schedule.
4. Form of ticket
For the purposes of section 63E of the Act, a ticket is in Form 2 set out in the Schedule.
5. Revocation
The COVID-19 (Prevention and Control) (Ticketable Offences) Regulations, Statutory Instrument, No. 177 of 2021 is revoked.

1. Citation
These Regulations may be cited as the COVID-19 (Prevention and Control) (Wearing of Mask) Regulations.
2. Interpretation
In these Regulations, “Act” means the COVID-19 (Prevention and Control) Act.
3. Requirement to wear a mask
A person shall wear a mask under section 21 of the Act if the person —
-
(a) is accessing health, police or fire services;
-
(b) is visiting —
-
(i) a senior citizens home or related institution,
-
(ii) a correctional facility, or
-
(iii) the Boys Training Center;
-
(c) is attending an educational institution;
-
(d) is attending a regular religious ceremony or special religious rite;
-
(e) has tested positive for COVID-19;
-
(f) has direct contact with other persons who have tested positive for COVID-19;
-
(g) is in an enclosed crowded environment;
-
(h) is accessing public transportation; or
-
(i) is required to wear a mask by a business, establishment or office.
4. Reasonable excuse for not wearing a mask
-
(1) Regulation 3 does not apply to a person who has a reasonable excuse for not wearing a mask.
-
(2) Without limiting subregulation (1), a person has a reasonable excuse for not wearing a mask if the person is —
-
(a) driving or is a passenger in a motor vehicle;
-
(b) a child who is under 5 years;
-
(c) a student who sits at a distance of three feet in a classroom;
-
(d) a person who is having a meal at a restaurant;
-
(e) a person who is exercising at the gym;

(f) a person who cannot wear a mask because of a physical or mental illness, impairment or disability;
-
(g) a person who is directed by a health practitioner to remove the mask for carrying out a medical or surgical treatment;

(h) a person who is receiving a service including a service from a barber shop, beauty salon or other similar service; or
-
(i) a person who is seabathing or in a swimming pool.

(3) In this section, “motor vehicle” does not include a tourism taxi or taxi.
5. Use of suitable covering
A person who, for medical reasons, cannot use a mask may use a suitable covering that is designed to cover the sides of the face and below the chin.
