3.   Licence fee payable in respect of yacht plying for hire

  1.  

    (1)   A licence fee in accordance with the provisions of section 4 is payable in respect of any yacht which may at any time ply for hire in the territorial waters.

    (2)   Subject to the provisions of this Act a yacht plies for hire in the territorial waters where it—

    1.  

      (a)     calls at any part of Saint Lucia in the course of a journey;

    1.  

      (b)     takes up or puts down passengers at any part in Saint Lucia; or

    1.  

      (c)     where there is any carriage for reward or any other use on hire or charter into or out of any part of Saint Lucia.

    (3)   The licence fee is payable to the port officer by the owner or charterer or hirer or any other person in charge or command of the yacht, and it is the duty of the port officer to pay all licence fees received into the Consolidated Fund.
