(1) Prior to incorporation of a company or change of name of a company, a person shall submit —
(a) a request for a name search in respect of the proposed name of the company in the prescribed form and pay the prescribed name search fee; or
(b) request for name search and name reservation in respect of the proposed name of the company in the prescribed form and pay the prescribed name search and name reservation fee.
(2) The Registrar may, upon payment of the prescribed name search and name reservation fee and provided that the name requested under subsection (1) is available for use, reserve for 90 days a proposed name of the company.
