2.   Interpretation

  1.  

    (1)   In this Act, unless the context otherwise requires—

alien” means a person who is not a Commonwealth citizen, a British protected person or a citizen of the Republic of Ireland;

appointed date” means the 22 February 1979;

British protected person” means a person who is such a person under the British Nationality Act 1948 of the United Kingdom;

Commonwealth” means Saint Lucia, the United Kingdom, Canada, Australia, New Zealand, India, Pakistan, Ceylon, Ghana, Malaysia, Nigeria, Cyprus, Sierra Leone, Tanzania, Jamaica, Trinidad and Tobago, Uganda, Kenya, Malawi, Malta, Zambia, The Gambia, Singapore, Barbados, Guyana, Botswana, Lesotho, Grenada, Dominica and any associated state or dependency of any of the foregoing countries;

Constitution” means the Constitution of Saint Lucia;

Consulate of Saint Lucia” means the office of the Consular officer of the Government of Saint Lucia or where there is no such office such office as may be prescribed;

foreign country” means a country other than the Republic of Ireland not within the Commonwealth;

Minister” means the Minister to whom matters relating to citizenship have been assigned.

    (2)   Persons born aboard a registered ship or aircraft or aboard an unregistered ship or aircraft of the Government of any country shall be deemed to have been born in the place in which the ship or aircraft was registered or as the case may be, in that country.

    (3)   Persons born aboard an unregistered ship shall be deemed to have been born in Saint Lucia if the ship is in the territorial waters of Saint Lucia.

    (4)   A person legitimated by the subsequent marriage of his or her parents shall be treated for the purposes of this Act as if he or she had been born legitimate.

    (5)   A reference in any enactment in the State to a British subject shall be construed as a reference to a Commonwealth citizen.

    (6)   The provisions of this Act shall have effect in relation to citizens of the Republic of Ireland who are not Commonwealth citizens in like manner as they have effect in relation to Commonwealth citizens.
