9.   Licence for boxing bananas

  1.  

    (1)   Any grower may apply to the Authority for a licence to erect and operate a boxing plant on his or her holding or to be engaged in the field packing of bananas and the Authority may, having regard to such factors and circumstances as may be prescribed, grant or refuse such licence.

    (2)   A licence granted under the provision of subsection (1) may be revoked by the Authority, if in the opinion of the Authority:

    1.  

      (a)     the person to whom the licence is granted has been proved to be incompetent to operate boxing plants or to field pack or has obtained, packed and presented bananas for export knowing that such bananas originated from a holding which is not licensed for field packing; or

      (b)     there has been a material breach of the terms and conditions under which the licence was issued.
