Any military member or any dependant who is detained in custody—
(a) under a sentence mentioned in section 13;
(b) pending the determination of a service court of a charge brought against him or her; or
(c) pending his or her repatriation to his or her home State,
is, for the purposes of any legal proceedings within Saint Lucia, considered to be in lawful custody.
