16.   Assistance in obtaining order in nature of restraining order

Where—

  1.  

    (a)     in Saint Lucia—

    1.  

      (i)     a person has been or is likely to be charged with or has been convicted of a serious offence, and

    1.  

      (ii)     a confiscation order has been, or is likely to be made confiscating property derived or obtained directly or indirectly, from the commission of a serious offence;

  1.  

    (b)     property so derived or obtained is suspected, on reasonable grounds, to be in a Commonwealth country,

  1.  

    a request may be transmitted requesting that an order be made, in accordance with the laws of the Commonwealth country, restraining dealings with identified property and that, to that end, the country give appropriate assistance.
