13.   Parties to proceedings

  1.  

    (1)   Civil proceedings by the Crown shall be instituted either by the Attorney General or by an authorised Government department in the official name of the head of such department.

    (2)   Civil proceedings against the Crown shall be instituted against the Attorney General.

    (3)   The Governor General shall by notice published in the Gazette specify the several Government departments which are authorised departments for the purposes of this Act together with the official names and address for service of the head of each such department, and may amend or vary any such notice.  Editor's note: Government departments which are authorised departments for the purposes of this Act are set out in S.I.230/1960.

    (4)   Proceedings instituted in accordance with this part of this Act by or against the Attorney General or by an authorised Government department shall not abate or be affected by any change in the person holding the office of Attorney General or in the person who is the head of an authorised Government department.
