28.   Onus of proof of ownership

  1.  

    (1)   In any proceedings under this Act, where any question arises as to the ownership of any land or tree or part thereof, the onus of proof shall lie on the defendant and not on the prosecutor.

    (2)   Any notice given or left at any premises under any provision of this Act or any regulation made under this Act may be addressed by the description of the “owner” of the land or ground (describing it) without any further name or description.

    (3)   On the trial of any person for an offence against this Act, the production to the magistrate of any notice purporting to be certified as a true copy by the Chief Engineer or such person duly appointed by him or her shall be prima facie evidence of the contents of such notice and of the service thereof.
