19.   Authority may give notice to remedy encroachments

  1.  

    (1)   If any fence, hedge or tree encroaches upon any road, or if any person neglects to trim the fences, hedges, trees or canes growing on any land owned, leased or occupied by him or her so that any road is encroached upon, the Authority may give notice in writing to the owner of the land to remove or remedy such encroachment.

    (2)   If such owner fails, within 3 days after receiving such notice, to remove or remedy such encroachment he or she commits an offence against this Act. However, it shall be lawful for the Authority after the expiration of 3 days from the service of any such notice to cause the removal of or to remedy the encroachment referred to in such notice and to recover the cost of such removal.
