13.   Authority may make temporary road

  1.  

    (1)   Where a road becomes impassable or dangerous the Authority may make a road through lands (not being the ground whereon any house stands, nor being a garden, yard, court, plantation, provision ground, or avenue to any house) to be made use of as a public road, whilst the old road is being repaired, widened, or altered, and the Authority shall make compensation to the owner or occupier of such lands for the damage he or she may sustain thereby, and in case of difference between them, the amount shall be assessed as provided in the foregoing sections 10, 11 and 12.

    (2)   In such case the magistrate shall estimate the advantage and disadvantage, if any, accruing to the adjacent land from the making of such a road.
